Are dao’s considered common enterprise under howey test?

In light of recent cases, I was wondering would dao’s be considered a common enterprise. Also as a follow up, there are decentralized smart contracts that have no employees at all. If a smart contract runs on its own would that be considered a common enterprise? Any help would be greatly appreciated.
