Lost Gas twice even though i offered more Gwei than Ethscan said

Hi guys, i dont know what happened here, i probably did 50-100 transactions with my ledger before.

Today i tried sending a transaction with 46 Gwei while Ethscan said 44 Gwei were average. The transaction failed "out of gas". TX: 0xa1673f98103738cc42b6d79b10dd4f1b8f98ad962cb2f3d9845ea4d84bcb1277

After that i tried sending another TX with 50 Gwei while Ethscan said 32 Gwei at the time of sending.
Again "ouf of gas". TX: 0x89dee14395781d6df82a7a4b2fef262dea62a268377e4c955cdca76c4d97da75

Whats happening here and how to fix it? I already lost ~11$ and i dont want to lose anymore.
