Why wouldn’t miners mine empty blocks on eip 1559

If people pay zero fees to the miner, then the miner has incentive to not include it, because it requires extra computation to add it to the block, and they receive no payment for the extra work. If I were a miner it would be Kore profitable to mine a block with zero transactions, or ones with tips
